Modern Daydream Privacy Policy

Modern Daydream LLC (“Modern Daydream,” “we,” “us,” “our”) respects your privacy. This policy explains what we collect, how we use and share it, how long we keep it, and the choices available to you. It applies to moderndaydream.com, our checkout, emails and SMS we send, and other services that link here. If you use our services, you agree to this policy and our Terms of Service. If not, please don’t use the site.
Information we collect
You share it with us
Name, email, phone and social media handles if provided, billing and shipping address, gift recipient details, photos you upload, the note you write to guide the artwork, and any messages you send to our team. Payments are handled by our providers; we don’t store full card numbers.
We collect it automatically
IP address, device and browser type, pages viewed, referring pages, and timestamps. We use cookies and similar tools to keep your cart, remember preferences, measure performance, and help personalize content.
We receive it from partners
Order and delivery updates from production and shipping partners, and basic attribution or analytics from platforms when you arrive via their links.
How we use information

We make and deliver your order, including sharing your photo and note with the assigned artist and production partners.

We improve and protect our site through analytics, quality assurance, and fraud prevention.

We send marketing only if you opt in. We use identifiable images of your finished artwork in marketing only if you opt in at checkout or later in writing. We may use anonymized or cropped details without identifying you.

If you are in the EEA or UK, we rely on contract, legitimate interests, consent, and legal obligation as applicable.
How we share information
We share only what’s needed to run the business. Shopify powers our storefront and checkout. Payment processors handle your payment. Production and framing labs and carriers make and deliver your piece. Email, SMS, and CRM tools help us send messages and manage opt-ins. Analytics and advertising tools help us understand traffic and, where permitted, run or measure ads. Fraud-prevention services reduce abuse and chargebacks. Professional advisers, auditors, and legal counsel assist as needed. If the company is involved in a business transaction, information may transfer as allowed by law.
We do not sell or share personal information for cross-context behavioral advertising.
Cookies and similar tech
Cookies keep you signed in, remember your cart, measure site performance, and help personalize content. You can manage cookies in your browser; some features won’t work without essential cookies. Where required, we’ll present a cookie banner for non-essential cookies.
If you are in the EEA or UK, we only set non-essential cookies with your consent and you can change your choices anytime via our cookie banner or Cookie Settings link. You can also use platform tools to limit personalized ads. We honor Global Privacy Control (GPC) signals where required. We don’t change collection for browser Do Not Track signals.
Photos, artwork files, and retention
You confirm you have the rights and consent to use the photo you upload, including for any minors who appear. We share your photo and note only with the assigned artist and production partners.
Unless you ask us to delete earlier, we keep source photos and production files for about 180 days after fulfillment to enable reprints or replacements and for quality assurance, then we delete or anonymize them from active systems. Backups roll off on their normal cycle. You can request earlier deletion of your source files and we’ll confirm once removed from active systems.
If you buy a digital download, your link unlocks on the timing stated in our Terms of Service and may expire later. Links are disabled if an order is canceled or refunded.
Data retention beyond photos
Order and tax records are typically kept for seven years or as required by law. Support messages are usually kept for up to 24 months after the last interaction. Account data remains while your account is active and is deleted upon request unless we must retain it. Marketing preferences are kept until you unsubscribe or request deletion.
Security
We use administrative, technical, and physical safeguards such as encryption in transit, access controls, and partner due diligence. No method is perfect, but we work to protect your information.
Your rights and choices
You can request access, correction, deletion, restriction, or portability where laws provide those rights. You can withdraw consent to marketing or to the use of identifiable artwork in marketing at any time. We may need to verify your identity before fulfilling a request. We’ll respond within 30–45 days as laws require. If you’re in the EEA/UK, you may also object to processing based on our legitimate interests where applicable and may lodge a complaint with your supervisory authority. US state residents may use the same email to appeal a denied request.

If you are in California or certain US states, you may have additional rights such as disclosure, deletion, correction, and opt-out of the sale or sharing of personal information. We do not sell or share personal information for cross-context behavioral advertising. You may also limit the use of sensitive data; we only use what you voluntarily provide to fulfill your order.
Children’s privacy
Our services are not directed to children under the age of majority in your jurisdiction (generally 18). If we learn we collected personal information from a child without parental consent, we will delete it. If a minor appears in a photo you upload, you confirm you have lawful consent to use that photo.
International transfers
We work with service providers around the world. When data moves across borders, we use appropriate safeguards such as Standard Contractual Clauses where required. When we transfer personal data from the EEA/UK to countries without an adequacy decision, we use Standard Contractual Clauses or another lawful mechanism. Copies are available on request.

If our site links to another site, their privacy practices are their own. Please review their policies.
Changes to this policy
We may update this policy. The date at the top shows when it took effect. We may highlight material changes on the site or by email. Continued use means you accept the changes.
